Is it right that a child be ineligible to participate in a graded concert for concert band due to a poor grade in another class?

Is not the concert part of the learning objective for concert band? According to MN statutes I thought co-curricular and extracurricular events could not be graded. Please help me understand this. The child has an IEP and somehow managed to have a failing grade in his English class during the two week eligibility check for the concert. The grade is back up now but he can't participate in jazz or concert band. He has to write two reports to make up the grade in each course. This child wants to pursue music in college. He is a 9th grader.
