The U.S. Supreme Court ruled Tuesday that states violate the federal Constitution if they bar religious schools from receiving state benefits afforded to other schools.
The 5-4 ruling in favor will affect laws and provisions relating to the separation of church and the state.
The ruling involved a Montana program launched in 2015 to provide tax credits for people and businesses making donations to private schools. However, a Montana state agency barred religious schools from receiving that money.
"A state need not subsidize private education," said Chief Justice John Roberts who wrote the opinion. "But once a state decides to do so, it cannot disqualify some private schools solely because they are religious."
