My OSEP (Office of Special Education and Rehabilitative Services) Comment

Has OSEP ever linked the new Multi-Tiered Systems of Support (MTSS) behavior requirements to the mass exodus of teachers? As a recently retired 25 yr California teacher, let me tell you my perspective: they ARE linked.

The problem is lack of oversight. Who checks to make sure a district has a viable MTSS program? No one. They are a lot of work to set up. It’s as if you put a bunch of unboxed, unlabeled computer parts mixed with Ikea furniture parts, sans directions, inside a room and expected a school district superintendent to put together a computer lab within a couple of hours. It isn’t going to happen! Same with MTSS. Viable programs just didn’t happen.

But school districts must send in suspension and expulsion statistics. And guess what? They both went wayyyyyy down. Do you know why? Because we no longer suspend or expel students. On paper, it looks like MTSS is a great success.

Behavior in TK-12 classrooms is out-of-control. Kids can throw pencils and spit spitwads the entire class period, and there are zero administrative supports. Students are on their phones the entire time – and admin will no longer allow teachers to confiscate them because of liability. Teachers are sworn at, spit on, shoved, and worse. And nothing is done.

OSEP made the point that ANY removal from a classroom is B.A.D. so teachers cannot send them out. Teachers can’t teach; good students can’t learn. And you know it’s true because the test scores are plummeting.

So OSEP, you have killed education in the name of equity. If you are going to impose expectations, you have to ensure that the pillars that will support them are in place. MTSS doesn’t really exist.

If you REALLY want to make a difference, then back up your words with action. Make sure that districts aren’t faking it. Make sure a REAL system is in place. Monitor compliance.
