Is it true that parents who abuse their children can remove them from school by default?

I apologize if the phrasing of the question is a bit stupid. In short, a Harvard law professor wrote in an article a few years ago that de facto parents can remove their children from school for any reason, and authorities have no recourse. Practically speaking, given that CPS tends to aim at keeping the child with the family unless (and often even if) there is a large chance that the child will be killed, it made me wonder how common it is for admin/teachers to see abused children removed from the system, with not recourse.

The term to designate removing the child from contact with mandatory reports is "homeschooling", but this question is not about homeschooling as such - just the consequences of the laws passed to allow homeschooling.
