1868 South Carolina State Constitution instituted an extremely progressive public school system.

In 1868, a new South Carolina State Constitution was rewritten as part of the post-Civil War "Reconstruction" laws. Developed by 76 Black and 48 white delegates, it became one of the most democratic and progressive state constitutions in the US.

Among many new ideas, it included significant updates to public education, including funding structures and universal and compulsory access, regardless of race or color, and included a structure for public higher education, and facilities for students with disabilities.

On funding specifically (Sec 5), it created a property tax, collected by the State, to be redistributed among all school districts in proportion to the number of students attending the school; religious/parochial schools did not receive these funds, and the constitution did not allow the teaching of any religion or religious ideas in public schools.

The new State Constitution was only enforced through 1876. Official Reconstruction ended, Federal troops left, and the Bourbon Democrats retook control of South Carolina through voter disenfranchisement. A regressive Constitution was instituted in 1895 by former-plantation owners, and nearly all progressive Sections were removed.
