Re: The members of NSHE's Board of Regents are unfit for leadership and public service
NSHE Board of Regents:
On Friday, November 12, 2021, the Nevada System of Higher Education will be holding an emergency meeting to replace the positions of Chair and Vice Chair, necessitated by Chair McAdoo and Vice Chair Carter stepping aside from these positions amidst outside investigation into the hostile environment perpetuated and tolerated during their tenures at the helm of the Board of Regents.
It is unacceptable for the Board of Regents to be appointing new leadership from within when the identities of the "unspecified regents" named in the latest hostile workplace complaint filed by the president of Truckee Meadows Community College have yet to be revealed. Former Nevada State Senator Warren B. Hardy II recently summed up this conflict of interest presently facing NSHE's Board of Regents: "Well, here's the problem with Friday. We really don't know the details of this new complaint. So who's gonna take over? Is it somebody who's got another complaint filed against them?"
With the lone exception of Dr. Lois Tarkanian, each current member of the NSHE's Board of Regents has engaged in numerous violations of NSHE's bylaws. The Board of Regents are hereby provided legal notice that yet another, official complaint regarding hostile environment is being filed Thursday, November 11, 2021 with the office of the Nevada Attorney General. Each current regent, with the lone exception of Regent Tarkanian, is being specifically named in this complaint.
Chair McAdoo and Vice Chair Carter: you are both being specifically named in a hostile environment complaint with the office of the Nevada Attorney General for failing in your elected obligations and responsibilities to protect and ensure the safety of students attending NSHE institutions. You have refused to respond to direct communications sent to you via both email and U.S. Postal Service. Worse, you have assisted NSHE General Counsel Joseph Reynolds in documented and confirmed “illegal, retaliatory measures to coerce, harass, and intimidate” law-abiding NSHE system students for lawfully reporting campus safety emergencies. Your negligence and the abuse of the powers of your positions necessitates your resignation from the Board of Regents as a whole; you are not merely unfit to continue serving as the Chair and Vice Chair, you are unfit for service on the Board of Regents as an entity. Vice Chair Carter, you are additionally being directly called upon to resign from your position as a Nevada educator, in furtherance of the safety of students.
Regents Del Carlo, Doubrava and Geddes: each of you are being specifically named in a hostile environment complaint with the office of the Nevada Attorney General for failing in your elected obligations and responsibilities to protect and ensure the safety of students attending NSHE institutions. During your respective tenures as the former Chair(s) and Vice Chair(s) of the Board of Regents, you each refused to respond to direct communications sent to you via both email and U.S. Postal Service. Worse, you have assisted NSHE General Counsel Joseph Reynolds in documented and confirmed “illegal, retaliatory measures to coerce, harass, and intimidate” law-abiding NSHE system students for lawfully reporting campus safety emergencies. Your aiding and abetting of the unlawful conduct of General Counsel Reynolds has allowed for additional students to be made victims of the same types of preventable and foreseeable crimes of violence for which you have unlawfully abdicated your legally elected obligations regarding. As an institution, NSHE has a legal responsibility to oversee the legal compliance of member institutions. Each of you has been directly aware of UNLV's abandonment of compliance with the Constitution of Nevada, as well as state and federal laws. Without lawful authority, you similarly abandoned your legal obligations and responsibilities to oversee the correction of UNLV's civil/criminal violations in these matters. Your abdication of your legal obligations and responsibilities has forever tarnished NSHE's reputation, and has irrevocably damaged higher education within the State of Nevada. Your misconduct necessitates your immediate resignations from the Nevada System of Higher Education's Board of Regents.
Regents Boylan and Brooks: you are both being specifically named in a hostile environment complaint with the office of the Nevada Attorney General for failing in your elected obligations and responsibilities to protect and ensure the safety of students attending NSHE institutions. Commendably, you both took the time to directly respond to matters involving ongoing campus safety emergencies impacting the lives of students. Unfortunately, despite your initial responses indicating concern, you have both unlawfully elected to engage in self-service, rather than securing the safety of students. For the safety of students system-wide, you must both immediately step down from the positions of power which you have abused.
Regent Boylan, you elected to defer to General Counsel Reynolds, despite being directly aware that General Counsel Reynolds has been publicly condemned by no less than 20 of his peers at UNLV's Boyd School of Law for engaging in “educational malpractice”; as well as the fact that General Counsel Reynolds has been directly involved in the documented and determined “illegal, retaliatory measures to coerce, harass, and intimidate” law-abiding students.
Regent Brooks, your misconduct has been deeply alarming and concerning. You were clearly able to directly confirm the ongoing campus safety emergency at UNLV, and elected to take zero action aside from deferring to General Counsel Reynolds, whilst simultaneously securing a campus concealed carry permit solely for your own personal protection.
Regent Arrascada, Carvalho, McMichael, Moran, and Perkins: each of you are being specifically named in a hostile environment complaint with the office of the Nevada Attorney General for failing in your elected obligations and responsibilities to protect and ensure the safety of students attending NSHE institutions. During your tenures on the Board of Regents, you have each refused to respond to direct communications sent to you. Despite what your actions imply, the safety of students is not a matter which you can lawfully ignore. It is one of the most basic obligations for which you have been elected. For the safety of students system-wide, each of you must immediately step down from the positions of power which you have abused.
Regent Perkins, on a related note, your recent public comment to KSNV is concerning. You stated, “We have eight highly capable presidents that are doing the day-to-day and making sure that that mission happens. Is it a little awkward? Yes. But is it completely hampering the business of making policy? No.” This statement is factually inaccurate and purposefully misleading to the electorate of Nevada. The two university presidents within your system, UNLV President Keith Whitfield and UNR President Brian Sandoval are both directly aware of the ongoing campus safety emergency within the NSHE system, and have abjectly failed to act in furtherance of the safety of students. Further, institution presidents are not responsible for system-wide policy; that is the sole responsibility of the Board of Regents. The ongoing dysfunction of the Board of Regents is, in fact, “completely hampering the business of making policy”.
Regent Tarkanian: we thank you for your decades of service within the UNLV community. While we have yet to hear directly from you, we understand that email is likely not your preferred method of communication. It is requested that you oversee the immediate termination of NSHE General Counsel Joseph Reynolds for his criminal participation in the confirmed and documented “illegal, retaliatory measures to coerce, harass, and intimidate” law-abiding students for lawfully reporting an ongoing campus safety emergency plaguing UNLV's campus. It is urged that you do not vote to confirm any of your colleagues to the vacated positions of Chair and Vice Chair, as none of these individuals are fit for leadership or public service.
Where law ends, tyranny begins. It is time for the tyranny of NSHE's Board of Regents to cease.
