Unfair punishment?

Hi,

I just have a simple question, is it considered unfair punishment to punish two students differently for commiting the exact same offence?

Background:

The offence in my situation is leaving school during the lunch break to get a sandwich from Subway. One student in my class did this 3 days ago and received a break time conduct detention (just 15mins during break, not bad at all). I do exactly the same thing 3 days later and I receive an after-school detention from the same teacher (stay behind for an hour after school and a phonecall home) which is wayy worse... I hadn't done anything similar in the past, or even done anything wrong that whole term so it couldn't be for past bad behavior... Is this fair??
