A useful power: in California, teachers can suspend students - and principals cannot interfere

CA Ed. Code Section 48910 States: "A teacher may suspend any pupil from class, for any of the acts enumerated in Section 48900, for the day of the suspension and the day following."

The teacher must let the principal know right away and must contact the parent/guardian and set up a meeting to be convened on a day ASAP. S/he CAN invite the principal, but doesn't have to.

The student cannot be returned to the class that day, or the next unless the teacher agrees, PERIOD. If an administrator returns the student to that class before then, they have broken the law. The student cannot be sent to another teacher's class unless it is a class specifically set up for suspended students.

Once I realized that administrators weren't going to remove dangerous students, I did this regularly. I had been tenured long ago in the days when administrators took safety seriously so I didn't fear losing my job (actually, I prayed for it).

I have no idea how a teacher can get through probation if they use this tool. But once tenured, it could be powerful.

Better yet, if teachers have to do their job, which should be all about imparting skills, PLUS do the administrator's job, which should be all about supporting the educational process, then teachers should QUIT. Teaching used to be great. But now it is too dangerous physically and emotionally.
